This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems of normativity due to (...) the fact that a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. Existe una larga tradición sobre las rúbricas pedagógicas de la escritura, principalmente referida a los niveles educativos no universitarios y con aplicación a la competencia lingüística en la lengua nativa o en una segunda lengua. En este trabajo se revisan los resultados de investigación referidos a la evaluación de la escritura creativa en niveles preuniversitarios y universitarios en contextos generales, en cuanto corresponden al desarrollo de competencias en la lengua nativa, más allá de su empleo en el desarrollo del pensamiento (...) crítico o en determinados ámbitos pedagógicos, y se ofrece una aproximación a los estándares de valoración del progreso de los estudiantes en esta disciplina. To understand the negative effect in the discursive multiplicity, it’s necessary to comprehend that the production of knowledge is not a free and natural exercise of the human spirit but a series of codes and rules of formation that leads to the production of speeches. That is the reason why we will take in high consideration Focault’s studies in the control of speeches. By doing this we will be capable to understand the way that subjects of knowledge, the epistemes and (...) the universal speeches (of all societies) are organized. We will use some arguments that belong to Latin American postcolonial studies to prove that discursive rank founded in the Western way of thinking allowed racial, social and cultural rankings that led to a global domination in many aspects. In this frame we will also introduce the “knowledge coloniality” category in order to define the way how the production of knowledge was under control in the colonial system (that, by the way, is still current). To bring matters to a close, this procedure will let us define the “geopolitics of knowledge” (as proposed by Mignolo) in a sense that cognitive capitalism is a geopolitical determination of the actual knowledge production. The aim of this research is focused on analyzing the alteration of the psychophysiological and cognitive response to an objective computerized stress test, when the behavioral response is controlled. The sample used was sports science students, with a mean age of 22.82 A quasi-experimental design was used in which the response of each participant to the DT test was evaluated. The variable “number of hours of physical activity per week” and the variable “level of behavioral response to stress” were controlled. (...) Before and after this test, the following parameters were measured: activation and central fatigue, and perceived exertion. Significant differences were found in all of the measures indicated. The usefulness of this protocol and the measures used to analyze the stress response capacity of the study subjects are discussed. (shrink)

Addressing fatigue is useful in a variety of scenarios and activities. Fatigue has recently been studied from a psychophysiological standpoint. As a result, the expression and impact of peripheral and central fatigue has been evaluated. Driving is one occupation where tiredness has disastrous consequences. BAlert is a smartphone app that approaches exhaustion with psychophysiological measures. More specifically, it evaluates the level of fatigue via heart rate variability data and the cognitive compromise via Stroop effect. The goal of this study is (...) to determine if there are gender differences in fatigue levels among professional drivers using the BAlert app. Statistically significant differences were found in the number of hours awake, in different parameters of HRV, in the level of stress, as well as in the cognitive response evaluated through the app. The results are discussed and their implications for the management of work fatigue are presented. However, this assertion lead to ask, which type of satire represent the Film. To structure these characterizations will be allude the Satire Theory of Friedrich Schiller, which works to delimitate not only the satirical elements of the story, but the mode the movie takes to become a critic to (...) the society. This article studies it from the point of view of Logic, with the purpose of revealing its petitio principii in relation with the analytical judgments. En este artículo pretendemos arrojar luz sobre la normatividad propia del conocimiento humano. Describimos el dominio normativo epistémico como un campo de agencia humana que está definido por el conocimiento entendido como logro. La normatividad del conocimiento se apoya en la contribución del agente epistémico a la consecución de ciertas tareas. Tal contribución es epistémicamente significativa cuando el agente llega a participar en la consecución del éxito. Por último identificamos algunos rasgos asociados con la agencia epistémica completa (condiciones de integración (...) cognitiva y autonomía epistémica), y aclaramos lo que queremos decir con implicación apelando a la idea de adoptar una perspectiva epistémica. Como casi todos los conceptos fi losófi cos, el de «validez normativa» tiene altos grados de ambigüedad y de vaguedad. En este trabajo me encargo de analizar la postura de distintos autores que han tratado de dar respuesta a la pregunta ¿qué significa que una norma sea «válida»? Para ello, tomo como hilo conductor la obra de Ernesto Garzón Valdés. Esto se debe a que los trabajos de Ernesto Garzón dedicados a este tema, le ofrecen al lector un análisis crítico (...) y comprensivo de algunas de las posturas teóricas más relevantes sobre el concepto de validez normativa. Asimismo, trabajar a través de su obra tiene un doble benefi cio: por un lado, no sólo nos permite conocer a fondo la postura teórica de autores que pertenecen a distintas corrientes del pensamiento, como Hans Kelsen, H.L.A. Hart, Francisco Suárez o von Wright por ejemplo, sino que, por el otro, nos permite conocer la postura del mismo Garzón y sus críticas a los diferentes modelos conceptuales. (shrink)

En este artículo analizamos los límites intrínsecos de nociones como la «dignidad humana» y otros análogos interculturales a la luz de la asimetría ineludible que imponen las reglas inherentes de inclusión, exclusión y jerarquía de todo lenguaje. En este marco, analizamos la excepcionalidad que supone la dignidad humana para el concepto mismo de los derechos humanos. Sobre esa base, sostenemos que es imperativo mantener diferenciados los privilegios que reconocemos a los animales humanos, de los derechos que reconocemos a otros animales (...) no humanos, sin que ello implique argumentar en desmedro de estos últimos. Finalmente, en el marco del análisis epistemológico y lingüístico, reconocemos el carácter paradójico e ineludible de los derechos humanos, que impone «violentamente» un orden de sentido que, en última instancia, parecen fundarse en la exclusiva voluntad del legislador. The aim of this text is to examine the issue of truth telling in doctor-patient relationships, namely in the case of terminal patients. We analyze the problems and attitudes regarding truth telling that there are present when patients suffer from mortal diseases. We conclude that it is very important to keep a fluent and truthful communication in the doctor-patient relationship. Third, considering the historical horizon as ontologically constitutive of Da-sein, we try to explain from real life what does this temporality mean and what does create mean, as well as why the creation of a work of art occupies an important place in relation to Heidegger’s proposal. We finally ask what is poetry to Heidegger and in what ways it is inseparable from the truth (aletheia). And we try to interpret the scope of Poetry (Dichtung) in relation to aesthetics and of language in relation to the truth. With growing public health and health equity challenges brought to the forefront — following racialized health inequities resulting from COVID-19 and a national reckoning around the deaths of unarmed Black victims at the hands of police — an antiracist health equity agenda has emerged naming racism a public health crisis.

In Spain, the state of alarm declared on March 14, 2020 caused changes in the population in relation to the habits of physical activity and sports practice. This study analyzed what motivational variables predicted the self-efficacy and commitment to sports practice, as well as the differences according to gender, during lockdown and the progressive de-escalation caused by COVID-19, using the theory of self-determination as a theoretical framework. The study sample was conformed of 179 subjects between 18 and 65 years of (...) age. The Behavioral Regulation in Sport Questionnaire, the Psychological Need Satisfaction in Exercise Scale, the Physical Activity Self-Efficacy scale, and the Sport Commitment scale were applied. The most relevant results have showed significant differences in favor of the male gender in terms of levels of controlled motivation and amotivation, as well as higher levels of self-efficacy and basic psychological need of autonomy. Furthermore, the regression analysis has revealed that self-efficacy and current commitment to sports practice were explained by a variance of 57 and 64%, respectively, due to autonomous motivation and the basic psychological need of competence. Therefore, the basic psychological need of competence should be fostered in order to increase the levels of self-determined motivation, self-efficacy, and commitment to sports practice of the population. La llamada "moral civil" tiene tres características principales: es una "ética de mínimos", es plenamente racional, y se establece por consenso. Sin embargo, la ética no se mide por el número de preceptos, y los sistemas éticos no pueden ser clasificados por un criterio de cantidad. Más aun, es un punto de partida falso considerarla como un pensamiento racional uniforme frente a una pluralidad de creencias religiosas. Y si el consenso es sólo el resultado de una votación, puede fácilmente convertirse (...) en una dictadura de la mayoría. Por tanto, la ética civil tendría que buscarse en el sentido amplio de la justicia en vez de establecer un sistema nuevo. (shrink)
